If you’ve been involved in a road accident or a work accident that resulted in injuries, the need for personal accident insurance arises. Of course, you are insured and everything, but what can you do to get compensated for your losses?
The first thing you need to do is to call your insurance company. Don’t take your time with this thing, because if you wait too much, you may be too late. You will be requested to file a compensation claim. Make sure that you respect all the deadlines, because you don’t want everything to go down the drain because you didn’t.
Then, a claim adjuster will analyze your case. You will be presented with a sum of money which will represent your compensation. You take a good look at it, and you have a nagging feeling that something’s not right. “Oh God, I need to call my lawyer”, you’ll be thinking. Ooops. Did I say lawyer?
Yes, that’s exactly what I said. But a lawyer is not the same thing as a lawsuit, so don’t be scared at the prospect of calling one. Your insurance company will want you to accept the smallest amount of compensation possible. And you’ll amazed by the big number of people who settle for nothing more than a big Sunday’s shopping in the mall sum of money.
But you know better. You know that you don’t necessarily have to take the bait and you call a lawyer, who will appoint you for a meeting. You have no idea how many very good specialists are available out there who will gladly help you. Either a road accident specialist or a work accident specialist, it doesn’t matter as long as you have a case.
Anyway, back to business. You go to the meeting with the chosen solicitor and you get interviewed by him. He asks you everything related to the case and you answer him honestly, because you don’t want to sabotage your own claim. If you have some pieces of evidence, it’s even better. They are like gold. Your lawyer will double-check them anyway and will look for more, but it certainly is a very good place to start.
Now, he will tell you how much compensation you can REALLY get and you say to yourself “Now that’s more like it. It’s all starting to make sense”. And now you have your attorney’s powerful negotiation skills at your disposal. That’s an important weapon.
But wait. “The lawyer may cost me more than my compensation”, you may be thinking. Again, that’s not true. There’s a little thing called no win no fee arrangement, or conditional fee agreement, how it is technically called. Working under such an agreement gives you the opportunity to pay your lawyer only with the condition of him winning the case. It’s a relatively new type of procedure.
So, according to the seriousness and the risk factor of your case, your attorney will have a basic fee and a success fee. The success fee is a pre-determined percentage out of the basic fee. The even better piece of news is that these fees may be paid if not entirely, at least partially, by your opponent.
A word of caution though. There were cases in which people took the “no win no fee” term for granted and found themselves having to pay serious sums of money. Why? Because they didn’t know that in the undesirable event that they lose the case, they have to pay the opponent’s costs. So, keep this in mind before going on with the procedures.
Now, the choice of getting compensated solely with the help of your insurance company or with the help of a lawyer depends on a simple factor: the seriousness of the case. If you have sustained minor injuries, there’s no point in hiring a lawyer and you should go for your insurance company’s compensation. I mean, this is what a personal accident insurance is good for, right?
